Can a person get into the military when they have been charged with aggravated assault?
Q. I am a student transition coordinator for a local high school for 'at risk' teens. Many of them are good kids, but have a criminal history. One individual is trying to turn his life around and wants to join the military. Can he get in with an aggravated assault charge?

A. Contact your local Army or Marine recruiters. They may have some methods depending on their current numbers. It is highly unlikely he will get a waiver from the Air Force or Coast Guard. I've had Soldiers who got in with moral waivers and if he completes high school and stays out of trouble he shouldn't have a problem getting in since we're still fighting a war. Maintain a networking link with your local military recruiters. It will speak volumes for your work as a coordinator and the impact on a kid's life within the community by performing such an honorable method of transition.

What happens to someone who gets aggravated assault and they have never been in trouble before?
Q. My boyfriend is in a bit of trouble and is being accused of aggravated assault. This is his first offense and he thinks he may be looking at time. What are his chances of getting probation? And does he need to get a good lawyer if he wants that?
Asked by @}-~KAT~-{@ - Sun Mar 7 15:14:05 2010 - Law & Ethics - 1 Answers - Comments
A. Many factors go into what a sentence will be. Past record is only one. Some other factors are your friends actions prior, during and after the fight, the severity of the injuries to the other party, what precipitated the whole thing. A clear record is a good start in hoping for probation. A good lawyer never hurts and may be able to get the charges reduced.

A. When you say aggravated assault it can mean about 1000 different things and all of them should have different amounts of time to serve. So unless we have the information about the exact crime committed and what state you are in we are mearly speculating .I can only guess that he or she will be sentenced to a minimum of 2yrs max of 5yrs-every state is different in my it depends on the judge as im sure it does in most states.felony or not in my recollection the most ive heard of someone getting for this was 10years-3yrs extended supervision (probation)-but that was also a 2nd offense.

A. In criminal law, assault is defined as the threat or use of force on another that causes a person to have a reasonable apprehension of imminent harmful or offensive contact. Aggravated assault is an assault accompanied by circumstances that make it more severe, such as the use of a deadly weapon, the intent to commit another crime, or the intent to cause serious bodily injury. Likewise, in criminal law, battery is defined as the application of force to another resulting in harmful or offensive contact. Like assault, there are generally two (2) types of battery. Is this aggravated assault or attempted murder?
Q. This is for a story I'm writing. Just say an argument happens at a party or something, and one person snaps and tries to strangle the other person, and they manage to hold their grip for quite a while. Their intention is to kill the other person. Is this aggravated assault or attempted murder, and how long would a person go to prison for this?
Asked by Danel - Thu Apr 1 12:21:39 2010 - Law & Ethics - 1 Answers - Comments
A. This is a common choice faced by prosecutors. The bottom line is that proving aggravated assault is easier than proving attempted murder. Juries have a hard time inferring intent to kill, even if the defendant used a weapon. So, most prosecutors go with aggravated assault and seek a deadly weapon finding. It really depends on the state for the prison sentence.

A. I have seen worse people get off with just probation. If it is the first felony offense, some states allow you to plead first offender. Also, it depends on the state, in some cases, if the victim drops the charges, the state won't pursue it. Also depends on just hour serious the injuries sustained were. Hope this helped.

A. In the US, forcible confinement is called kidnapping. That charge alone can carry up to life in prison. Robbery - or in this case, since there was a weapon involved, armed robbery - can net up to 25 years in some jurisdictions. Aggravated assault witha weapon is a few years. Canada may be nicer to you than the US would be in this case. - Stuart
