will the assault charges hinder my visitation with my kid?
Q. i'm 17 and my girlfriends mom called just now to say she is going to be pressing assault charges on me. (i hit her). i have two other assault charges before from school fights. i have a child, 3 months old. is this gonna fuck up my visitation with my son? * I hit my gf, not her mom. sorry, worded badly.

My friend claims assault charges were wrongly filed against her husband. She says that 911 was dialed?
Q. accidentally and police came to the house. She says that since she had scratches on her face(she claims it was from her cat), they had to press charge against her husband. I know the state will pick up assault charges, but I thought they would need an original statement from the victim saying that there was assault?

A. If the offense occurs on the military installation the soldier will either face a judicial or non-judicial proceeding. A military member who accepts non-judicial action could face severe reprimands or discharge. Accepting judicial proceedings with a guilty verdict would most likely result in a discharge in addition to any jail time given. With a civilian charge, the military will normally await any findings of the civilian court. If found guilty, the military member could face an administrative discharge.

what would a soldier facing sexual assault charges expect upon redeployment?
Q. ok, so i was the victim of a sexual assault while deployed. it was reported and statements filed, the whole thing. even if i decide not to press any kind of charges, will he still be discharged from the army upon re-deployment just for the charges? or is that up to the commander? if anyone can offer experience with this type of thing. thanks

A. "How long is a piece of string?" Bail is set by the judge, and is set on a case by case basis. No-one can know what it will be until the hearing is held and the judge sets the amount. Be aware that the 10% option is a bail bondsman's fee... it is money paid to a bondsman for putting up the bond, and you do NOT get it back ever. If the bail is low enough, and you can afford it, it is better to pay the whole bail yourself and not use a bondsman, because then you get it back. Example... The judge sets bail at $10,000 Choice 1) You pay $1,000 to "Joe's Bail Bonds", and he issues a $10,000 bond. If your friend shows up for her court dates as ordered, "Joe" never has to pay up on the bond, and he makes $1,000 profit. [cont.]

just out of prison and have another 3 assault charges to face?

A. quite simply, you are a fool. You will get a longer custodial sentence this time and to be honest it serves you right. If you cannot control yourself when you have been drinking, and know this, then don't drink to the extent that you lose control.

I want to drop domestic assault charges before it goes to court.?
Q. How likely is the District Attorney in TN to drop domestic charges on a first time offender where the assault occurred after his tour of duty (PTSD is likely the cause) and the victim doesnt want to proceed - the state pressed charges? How would the victim go about getting the charges dismissed? What is the MOST effective way? Call the police officer who pressed charges, the DA? etc. We are in TN. Thanks!

A. If the state pressed charges, then only the state can drop those charges, and arent obligated to do so. Call your local Non Emergency Police number. Look it up if you dont know it.

Can domestic assault charges be dismissed if the plaintiff doesn't show up on court date?
Q. The court date is soon. Mother filed domestic assault charges against her 18-yr old daughter. Her father has been told if the mother doesn't show up for the court date (mother has many regrets she filed charges), the charges will be dismissed. As an aside, there was no physical evidence of any assualt! Can the charges be dismissed if the mother doesn't show up for the court date? If she does show up, what are the consequences for the daughter? Can it be expunged on down the line?

A. Mom can be charged with contempt of court, and the trial will be rescheduled. The courts are taking a hard line approach to domestic violence for that very reason... victims drop charges, the suspect is not held accountable, and the violence continues. It is ultimately up to the prosecutor, but worst case mom gets charged with contempt of court. I've actually had a case where that happened. The wife didn't show up, they issued a bench warrant, and she sat in jail until the case could be rescheduled. That was an extreme case, but is is legally possible.

A. She only has a couple of days to make a case. However, she'll need to contact the police & make a statement to them. The police will write a report & send it to the DA. It will be the DA that will decide if charges are to be filed. If the kids are little, I doubt very seriously if the police will do anything.

A. When you press charges against someone you are not responsible for any charges. The state where you live pays for the filing fees and court appearances. If you choose to sue in civil court and win once again the person whom you sue if they loose will be held responsible for court fees and costs.

A. Anyone in Saskatchewan (or anywhere else in Canada I would assume) who has filed any charges can drop them for any reason. This can be a person, or the Crown if they feel it necessary. In this case, the person who was drunk and high has every right to drop charges against you, but it sounds like you may want to inquire about having them charged with making a false statement to police. Just a complaint is sufficient to show up on your record here.
