If someone pressed charges for assault on you but during the fight hit you too, can you press charges back?
Q. Like say they don't really know who started it but both sides are saying the other person started it. One person has already pressed charges can i press assault charges on them too since no one knows who started it and we both got hits in?

A. It is not up to you, domestic assault charges are laid by the crown prosecutor on advice from the police. If there is sufficient evidence to charge the defendant, then they will proceed. What you want has nothing to do with the charges. Edit - you do not want to be with any guy who thinks that even a possible hint of violence is acceptable. You need to gather up your self respect and find someone better, who loves you and thinks you are the most fabulous person on the planet. Move on. Head high, with self respect and dignity.

And in some cases even if they don't officially charge you, the possibility that you did it alone could be enough to effect your career if documentation of the investigation goes in your record. A. quite simply, you are a fool. You will get a longer custodial sentence this time and to be honest it serves you right. If you cannot control yourself when you have been drinking, and know this, then don't drink to the extent that you lose control.

If it was only hands creating the injury it could be less sever.In California if it were a non weapon assault and a first offense, it could be anywhere from 0 to 12 months in jail.If their is a weapon involved depending on the seriousness of the persons injury you would be looking at state time in a penitentiary.It depends on the state your in to start out with.And also if the person committing the crime has prior convictions.If it's a first time offender it will usually go easy!
