Do you think I can get the domestic assault charges dropped?!?
Q. My ex-bf and I were living together and he was selling a bunch of things he got me as presents and I got mad and told him to give me back the ps3 I got him and broke into his room which he was in at the time and he charged me and we got into a scuffle where he kept pushing me and saying he'd break my arms if I didn't leave and at one point we fell and I guess I scratched him which in turn he called the cops on me for it and I got arrested for domestic assault even though I don't remember scratching him and if I did it was completely accident and he started the fight and threatened me. I was also never read my rights when they took me away. please help!! AHK I'M going crazy! oh and my current boyfriend saw it happen but the cop just kind of… [cont.]

A. You broke into his room,even tho it was a common living arrangment and then physically assaulted him..your pretty much screwed,lucky they only hauled you off for domestic instead of flat out assault and battery..as for "reading you your rights" they only have to mirandise you before conducting a custodial interrogation , if they didnt advise you,then anything you said after that (as a result of direct questioning)wouldnt be admissable in court.However since theres no need for any interrogation on a DVA ...expect a large fine and probation if its your first offense.

A. I want to drop domestic assault charges before it goes to court.?

How likely is the District Attorney in TN to drop domestic charges on a first time offender where the assault occurred after his tour of duty (PTSD is likely the cause) and the victim doesnt want to proceed - the state pressed charges? How would the victim go about getting the charges dismissed? What is the MOST effective way? Call the police officer who pressed charges, the DA? etc. We are in TN. Thanks!

A. If the state pressed charges, then only the state can drop those charges, and arent obligated to do so. Call your local Non Emergency Police number. Look it up if you dont know it.

Is it possible to get a misdemeanor domestic assault charge removed from my record?
Q. I got into a physical fight with my husband. Alcohol was involved. He provoked me into a rage and a grabbed for his throat. He choked me back. He got off of me, and then destroyed 15 glass picture frames and flipped over a dresser. I called the police because I thought he was going to destroy my entire house. The police ended up arresting me, and throwing me in jail. My husband got to stay in the nice warm house, while I froze in just a night shirt. I ended up walking in near freezing weather in just my night shirt, no shoes, no money. I walked 5 miles to get from jail to my house. 4 police cars drove past me and didn't offer to help me. This has been the most humiliating experience of my life.

On 6/11/11 my boyfriend and I got in a huge fight with my best friend in the room and then he started to grab me and a lot of other things happened but I ran outside after things got worse and one of my neighbors called the police and he was arrested. A. The way domestic violence laws are written these days...you don't have to press charges if there are visible signs or evidence of an assault. The police are required by law to make an arrest whether the victim wants them to or not! You can't dismiss nor drop charges against anyone...you aren't the complainant in the case...the State of New Jersey is the complainant.

A. I would not plead guilty unless the prosecutor gave me a really great deal, such as probabtion and/or community service instead of jail. Psychological abuse is part of the Domestic Violence laws, too. You could make a case of that against your ex. Yelling and bumping into you is quite threatening behavior, and he was provoking you. I would bring all of this up to an attorney or to the judge. Our Domestic Violence laws today are all out of proportion to the realities of human nature. Beating is obviously wrong, but most couples at one time or another have exchanged a slap or a bit of a smack of some sort. It used to be considered normal. A. It is not up to you, domestic assault charges are laid by the crown prosecutor on advice from the police. If there is sufficient evidence to charge the defendant, then they will proceed. What you want has nothing to do with the charges. Edit - you do not want to be with any guy who thinks that even a possible hint of violence is acceptable. You need to gather up your self respect and find someone better, who loves you and thinks you are the most fabulous person on the planet. Move on. Head high, with self respect and dignity.

According to Minnesota Statutes, sec 624.712, subsection 5, offenders of assaults of the 1st, 2nd,3rd,and 4th degree are considered crimes of violence and thereby prohibited, 5th degree is not identified. Whether you receive a permit or not is still up to the Minnesota issuing/approving authority depending on the circumstances of your arrest/charges.

A. Get the case number and contact the prosecutor, the court or the police department. And depending on your situation you might be able to get a order of protection.

My ex husband put a domestic assault charge on me because he was crazy jealous that I was about to marry some?
Q. I have joint custody of my 2 children with my ex husband however they reside with him,and because he has put a charge on me and the judge found me guilty,I am not being hired at all. I am not sure I am not being hired for a job because of my conviction,however when they hear about my charge they decline me. I live in the State of Virginia and I cant pay child support what do I do plz help

How common is it that courts order mental assesments or evaluations in simple domestic assault charges?
Q. is this same in the UK as well? (just out of curiousity) why so for this? when did this begin, if so? what types of medication can /would they treat the person with or what types of things?

A. It is very common if it can be proven that you might have a mental illness. And depending on what you did in the domestic assult ~ you can be ordered to get an evaluation...If alcohol or drugs is involved, you can be ordered as well. Depends on what your mental illness is, will determine what medication you would be given. It could be something as simple as an anti-anxiety to something more stronger like a mood stabilizer or an anti-psychotic. Stop hitting people and you won't need to worry about this. Perhaps anger management would be also ordered.
