False Police Report Answers

This girl is filed a false police report on me. What can I sue her for?
Q. This girl filed a PPO on me for harrasement. Over the past 6 months, shes probably called me 2000 + times but says I'm harrasing her. I have my phone records and I'm obviously fighting it. If I win the case, I'm filing a lawsuit for lawyer fees, court cost to fight it but can I go after her for humiliation, embarrasement etc... and then go after her for filing a false police report?

a false police report was made against me. No one was arrested but I believe he is going to use it in court to?

A. Depends on several things, such as the credibility of the witness. Unfortunately, the system doesn't always work. Most often, there needs to be more than one witness to coaborate the situation. Otherwise, it becomes a he said/she said thing. Sometimes, whoever committed the crime actually gets away with it, because the witness will lie for the criminal. When that happens, it is the witness who should be put in jail.

A. What mess? What harm was done by the report? If an arrest was made on false information, yes you would have an actionable case. ... and if an arrest was made, the lawyer will be looking at the basis for the charge, how information / evidence was obtained, etc. Short of that, what damage was done ? ... and was the report anonymous ?

A. Ugh, someone did this to a really close friend of mine. It was sickening. Just call the police and tell them your situation. They will tell you the proper procedures to follow. Basically, I ended up meeting with a detective and telling him that the accusations this other person made were completely false and explained how I knew this. In the end, it should blow over and all there will ever be is a file that I believe is called a "suspicious circumstance" report. No one will ever see it and it shouldn't affect this someone in the future. But I understand how much it must suck to see someone be falsely accused. I don't understand how anyone could justify such a malicious action.

What happens if I file a false police report in Arizona?
Q. My husband and I got into a small spat and he hit me. I went to the hospital and did not tell the docs/nurses that my husband hit me. Arizona is crazy about Domestic Violence... to make a long story short my husband got arrested on Domestic Violence Charges. A. So, your going to say you filed a false report when you didn't even file one to begin with? The courts/police don't need your permission to charge him. Your husband is an asshole and deserves to go to jail. You are a moron if you want to drop the charges. Luckily the police and courts are smarter than you and are pursuing charges anyway. Don't say we didn't warn you when he beats you to death.

what are the charges for someone making a false police report?
Q. Someone has made a false report on me and my husband twice in one day of kidnapping. Every time the cops tried to get ahold of her she would be gone from where she was, and not answer her phone. A. Police work under the clause of "good faith". They make a good faith effort to record the events as they are reported and what the officer observes. Everyone makes mistakes and everyone perceives things differently, including police officers. Officers are not exempt from having a bad day or missing things. People sue departments all the time, officers get paid time and 1/2 for court time. A. Consequences depend on where you made report. In CO is Class 3 Misdemeanor meaning min of 50 bucks, max 6 mo jail & 750 bucks. Tell lawyer. Recant (take back) report. The longer you wait and cause time to be spent on prep for prosecution and waste judges time the worse it will be. Get statement, sworn affidavit, something from accused person that they hold you harmless, desire no complaint against you, etc. Have lawyer give to District Attorney ASAP. Get an MD to put something in writing that you are PG. Also give to DA. Acknowledge you were wrong (bypass cops) and request community service if you plea no contest to a lesser offense. If someone filed a false police report against me what do I do?
Q. I was falsely accused of video taping someone without there permission. I never made the tape and the tape that was given into evidence was a video that was emailed to the police. The police claim they cannot get the original copy because it is out of state. The copy is not clear and I do not remember being asked to be recorded myself. A. File a separate police report against the person of defamation. Defamation law is different from place to place, some places only require the individual to say a false statement to one person, or it may be needed to be said to many people, or in writing, or in public. (This all depends on your country regarding defamation law).

A. Nope. The police officer was acting in good faith based on the information he had. If you believe that you are innocent then you need to hire a computer forensics expert to examine your computer and determine if your system had been comprimised. remember tha tthe police officer has no reason to believe you and that your own description tells us that he had enough information to reasonably suspect you of the crime.

A. Why would a person file a police report at all for minor damage? If its for an insurance claim, its usually not required (although the companies like you to). But making a false insurance claim is probably a felony depending on the amount. Although, there isn't really any way for the insurance company to find out.

Q. I recently filed a battery report against my fiance because I wanted to leave the house and was scared of what was going to happen. A. It is common for abused women to feel guilty and recant their story later. Unfortunately, that only empowers the abuser because he now know she can get away with it. Statistics show it takes conscious thought to make up a lie, but the truth comes naturally. For this reason, the statements you made on scene while in a heightened emotional sate will be given more credibility. Changing your story may even work against you, as the prosecutor could use it to show you area a true victim of abuse for the reasons above.

This is a long shot because I know little of your situational specifics It sounds like there was an A ligation made but you have not been criminally convicted of anything in that case if the matter goes to trial make sure to work a good case with a good attorney and that should clear you If the matter simply gets dropped you may be able to get a written statement saying that the DA is not pursuing a case so legally an offense was not committed Also your bureau of prisons may be helpful in finding out if there is a way to appeal your denial More details on your case are needed for a better answer

Q. This girl filed a restraining order on me saying I harrassed her. She got it so I cant come in contact with anybody in her family even thought I've never met them so it's kinda hard to avoid them. I'm bringing her to court to fight it because I have my phone records showing she called me 2000+ times and have several voicemails of her saying call me back. A. The cops are just like us, they want to put in their time and go home. They aren't going to do anything automatically. You could try suing her for defamation of character in civil courts. Good luck finding a lawyer to represent you though, unless she has lots of money. You could however pay a lawyer to draw up some papers and send them to her by registered mail. This might scare her if she thinks that you are going to take her to court. My ex filed for a restraining order against me, that was false of course. She put in the filing that the she owned the house that was actually my moms and I was kicked out by the police and her and her family emptied the house of everything but the furniture.
